Terms of Service
The agreement between you and Kinship when you buy something from this site.
When the contract forms
Adding a piece to your bag does not reserve it, and neither does starting checkout — almost everything we hold is a single piece, and the first completed order takes it. Your order is an offer to buy; the contract forms when we email you to say the piece has been despatched.
If we cannot fulfil an order — the piece failed its second authentication check, or two orders arrived within seconds of each other — we cancel it and refund in full, immediately and without deduction.
Authenticity
Every piece we sell is guaranteed authentic without a time limit. If any piece bought from us is ever shown not to be, we refund the full purchase price, whenever that happens and whoever owns it by then.
We are an independent reseller. We are not an authorised dealer for, nor affiliated with, any of the houses we carry, and we do not act on their behalf. Their names and marks are used to describe what a piece is, which is the ordinary meaning of a trade mark.
Condition and description
Photographs are taken by us, of the exact piece listed, and are not retouched beyond colour-correcting to the room's light. Where a piece has been carried, the description says so and the photographs show where.
Colour on a screen is approximate. A difference between how a piece looks on your monitor and how it looks in your hand is not a fault, though it is a perfectly good reason to return it under the returns policy.
Pricing and errors
Prices include UK VAT and are set as described in the pricing policy. If a piece is listed at an obviously wrong price — a decimal point in the wrong place — we are not obliged to sell at it. We will tell you before taking payment and you can confirm at the right price or cancel.
Your account
Keep your password to yourself and tell us if you think someone else has it. You are responsible for orders placed through your account. We can close an account that is being used fraudulently, and we will say why.
Liability
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Subject to that, our liability for any order is limited to the value of that order.
TO CONFIRM: this clause is a placeholder shape. The client's solicitor must draft the operative limitation and the governing-law clause below.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK or the EU, you keep the protection of your own local law and can bring proceedings in your own courts.
